The writ of prohibition granted Deputy House Speaker Tokpa Mulbah does not mean he is free in the alleged flogging of policeman Lexington Beh, but the writ protects him

to remain outside the investigation in keeping with law, Associate Justice  Kabineh M. Ja’neh clarified here Thursday.

He told reporters that police investigation will have to gather and ascertain sufficient evidence to warrant indictment of the deputy Speaker by a grand jury.
Justice Ja’neh noted that the Deputy Speaker has certain immunity under the law, and like any other citizen, he has the right to remain silent while the Police conduct and gather evidence leading to prosecution.

According to Justice  Ja’neh, the writ of prohibition ruling is only intended to keep him (Deputy Speaker Mulbah) out while police investigation continues in keeping with the law.

This means the Deputy Speaker could be indicted based on evidence that the police will gather in connection with the brutal flogging of Police Patrolman  Lexington Beh on 10 July 2010.

Police invited the Deputy Speaker for questioning on July 12 thus prompting Rep. Mulbah and his lawyers to run to the Supreme Court seeking a writ of prohibition.
He and seven aides stand accused for the flogging policeman Beh  while serving duty at the Police check point  at Thinkers’ Village on the Monrovia-Robertsfield highway.
